Detention
The circumstances in which an asylum seeker may be detained (Section 9 (8) of the Refugee Act 1996) are where it is suspected that he or she;
- poses a threat to national security or public order in the State
- has committed a serious non-political crime outside the State
- has not made reasonable efforts to establish his or her true identity
- intends to avoid removal from the State in the event of his or her application for asylum being transferred under Dublin II Regulation or to a safe third country
- intends to leave the State and enter another state without lawful authority
- without reasonable cause, does not possess valid identity and travel documents or where the documents have been destroyed or are forged.
