Without Condition As To Time Endorsements
From 1 June 2012 we no longer require original passports to be sent in to INIS at application stage
Due to a very large increase in applications for Stamp 5 it has been decided to change the procedures. It is no longer necessary to send in the original passport at the initial stage of the application. Instead please include a full colour copy of your passport(s) to show all permission stamps. If the endorsement is to be granted a request for the original passport will issue.
Since 1st December 2010 we no longer accept Without Conditions As To Time applications from people who have a stamp 4 and already have a long term residency in the State. You can only apply for WCATT if your Stamp 4 permission has less that 6 months to run. Applications from people with Stamp 3 stamps continue to be processed as normal.
Without Condition As To Time (WCATT) Stamp 5 is placed in the passport of an individual who has completed 8 years (96 months) of legal residency in Ireland. The Stamp 5 states:
"THE HOLDER OF THIS PASSPORT IS PERMITTED TO REMAIN IN IRELAND WITHOUT CONDITION AS TO TIME."
This stamp is valid to the expiry of the passport in which it is placed.
Categories of qualifying person
If a person has a previous Without Conditions As To Time (WCATT) Stamp 5 in their passport this WCATT can be renewed for a new passport.
Legal residence means having a stamp in your passport
being registered with Garda National Immigration Bureau (GNIB).
Both of these conditions must be met to have legal residency in Ireland.
NB: APPLICATIONS WILL BE AUTOMATICALLY REFUSED IF BOTH OF THE ABOVE CRITERIA ARE NOT MET.
Which Stamps Count towards WACTT?
Only immigration stamps in a passport can be counted towards a Without Conditions As To Time application.
The following stamps do not qualify for Without Conditions As To Time stamp (Stamp 5).
- Student - Stamp 2
- Temporary Registered Doctors - Stamp 4
- Trainee Accountants - Stamp 1A
- Intra Company Transfer - Stamp 4
- Spouse or dependent of an Intra Company Transfer – Stamp 3
If you have any of these type stamps in your passport they will not be counted towards the 96 months legal residence required.
When To Apply
You may only apply for a Without Conditions As To Time endorsement when you have completed 96 months legal residence.
If you are on a Stamp 4 you can only apply in the last 6 months of that permission.
If an application is received from a person before the 96 months legal residence has elapsed the application will not be accepted and will be returned.
If an application is received from a person with more that 6 months permission on left the application, with a Stamp 4, it will not be accepted and will be returned.
How To Apply
If you have completed 8 years (96 months) legal residence in Ireland
you have 6 months or less permission left to run (except stamp 3) you may apply for the Without Conditions As To Time (WCATT) Stamp 5.

This application must include a cover letter and the following documents:
- Full colour copy of your past and current passport showing all your immigration permissions to be in the State and
- A copy of the GNIB card and
- Current address
If the endorsement is to be granted you will be asked to forward your original passport via registered post. You will also be required to include a pre paid self address registered envelope (available from An Post).

Renewal of Without Condition As To Time (WCATT) Stamp 5
If you have a Without Condition As To Time (WCATT) Stamp 5 it may be renewed by post. In order to renew the Without Condition As To Time (WCATT) Stamp 5 you must submit a full colour copy of both your expired passport, and your current passport to;

All applications must be accompanied by the relevant documentation and a short covering note including all your contact details.
Points to Note
- It is not necessary for your stamps to be continuous but you must be legally resident in the State at the time of the application.
- A WCATT Stamp is only put into a national passport. It is not put into a travel document.
- A WCATT Stamp is only granted when the Minister is satisfied that you are a person of good character.
- When you receive the Without Condition As To Time (WCATT) Stamp 5 in your passport you must then register this with GNIB before your current permission expires. If you do not register the Stamp with GNIB you are not legally resident and you risk becoming illegal. The Stamp 5 is only a valid permission when you have registered it with GNIB and have received a certificate of registration.
A Stamp 5 permission to remain does not confer any entitlement or legitimate expectation on any other person, whether related to you or not to enter or remain in the State.
The Stamp 5 does not confer any entitlement on any family member to receive a Stamp 5 or Stamp 4. Each person must qualify for the endorsement in their own right.
NB Due to the volume of applications the Department is unable to provide a processing time frame.
It would greatly assist us if you only contact us if it is absolutely necessary as this will allow us to devote the maximum time to the processing of applications.
All requests for return of applicants passports prior to the complete processing of the application must be forwarded to the above address in writing.
If your passport is returned to you prior to the completion of your application, your application will be deemed withdrawn, and a new application will have to be submitted to the Department.
