Procedures for Requests
Format of Requests
- Requests must be made in writing, and the original document should be sent to the Central Authority.
- Faxed copies will be accepted on the understanding that the original request will be sent immediately.
Language of Requests
Requests must be made either in
- Irish
or - English
If a request is sent in any another language, a certified translation must be sent with it.
Details to be Supplied in the Request
- Name and address of the requesting authority, including the name and telephone number of a contact person
- Details of the reason for the request
- Details of the person named in the request, including address, date of birth and nationality, if available
- A description of the offences charged or under investigation
- Relevant dates – for example, date of court hearing
- A description of the evidence sought, including, in the case of bank accounts, name of the institution, account numbers and account names
- If evidence is to be taken from witnesses or suspects, details on whether it should be evidence on oath before a judge
- A list of any specific questions to be put to a witness, if possible
- Information on any property to be searched and/or seized
- Details and supporting documents in relation to the freezing, confiscation or forfeiture of criminal assets
- If a summons or a judgement has to be served, information on whether the document should be served personally or by post.
- Name and details of a contact point where enquiries can be made on allowances and expenses by the person who has been asked to appear
- Whether the requesting country wishes to have persons present during the taking of evidence in the proceedings
- If the requesting country requires a prisoner in Ireland to give evidence or assistance in an investigation in that country, full details of the arrangements made for the transfer of the prisoner
