How can I obtain a gaming licence under Section 19 of the Gaming and Lotteries Act 1956?
The relevant local authority having passed a resolution under Section 13 of the 1956 Act, an applicant then applies to the District Court for a certificate authorising the issue of a licence permitting gaming at an amusement hall or funfair.
The court may attach conditions to such a certificate, for example:
- limiting the hours during which gaming may be carried on
- restricting the kinds of gaming and the extent to which particular kinds of gaming may be carried on,
limiting the amount of stakes and prizes
- or restricting gaming by people under a certain age
The certificate will also specify the period for which the licence is valid in that particular year. (A licence can be issued for a maximum of one year.)
When you receive the certificate, you submit it to the Revenue Commissioners and they will issue the gaming licence, on payment of any excise duty provided for by law and provided a relevant tax clearance certification in relation to the licence has been issued.
How can I obtain a lottery permit or licence under Section 27 or 28 of the Gaming and Lotteries Act 1956?
A permit application is made to a superintendent of An Garda Síochána for the district in which the applicant is residing.
A licence application is made to the District Court under the conditions as laid down in Section 28, and under Section 29 a 28-day notification must be given to the superintendent of An Garda Síochána for the district in which the lottery is to be held.
Note: There are a number of significant conditions and restrictions included in the Gaming and Lotteries Acts 1956–1986 in respect of lotteries and the Act should be consulted in regard to those.
