Transposition of EU Directives

This page contains information on EU Directives transposed since 1 January 2011 by the Department of Justice and Equality. Information on Directives currently awaiting transposition is also included.


Directives transposed since 1 January 2011

Directive 2008/52/EC of the European Parliament and of the Council on certain aspects of mediation in civil and commercial matters 
Date adopted: 21 May 2008
Current position: The Directive was transposed on 5 May 2011 by the European Communities (Mediation) Regulations 2011 (
Statutory Instrument No. 209/2011).



Directive 2006/24/EC of the European Parliament and of the Council on the retention of data generated or processed in connection with the provision of publicly available electronic communications services or of public communications networks and amending Directive 2002/58/EC 
Date adopted: 15 March 2006
Current position: Part of the Directive is covered by Part 7 of the
 Criminal Justice (Terrorist Offences) Act 2005. The remainder was transposed by way of the Communications (Retention of Data) Act 2011, which completed all stages in the Houses of the Oireachtas on 20 January 2011 and was signed by the President into law on 26 January 2011.



Council Directive 2005/85/EC relating to the minimum standards concerning the procedure for granting and withdrawing refugee status in Member States
Date adopted: 1 December 2005
Current position: Irish law and practice in this area was already substantially in compliance with the terms of this Directive. All outstanding aspects of the Directive were transposed on 1 March 2011 when the European Communities (Asylum Procedures) Regulations 2011 (
Statutory Instrument no. 51 of 2011) and the Refugee Act 1996 (Asylum Procedures) Regulations 2011 (Statutory Instrument no. 52 of 2011) came into operation.



Directive 2012/4/EC amending Directive 2008/43/EC setting up, pursuant to Council Directive 93/15/EEC, a system for the identification and traceability of explosives for civil uses
Date adopted: 22 February 2012
Current position: The Directive was transposed on 6 April 2012 by the European Union (System for the Identification and Traceability of Explosives for Civil Uses) (Amendment) Regulations 2012 (
Statutory Instrument no. 106 of 2012).


Directives Awaiting Transposition


Directive 2011/36/EC on preventing and combating trafficking in human beings and protecting its victims, and replacing Council Framework Decision 2002/629/JHA
Date adopted: 5 April 2011
Transposition deadline:  6 April 2013
Current position: The Directive is awaiting transposition which is due on 6 April 2013.



Directive 2010/64/EC on the right to interpretation and translation in criminal proceedings
Date adopted: 20 October 2010
Transposition deadline:  27 October 2013
Current position: The Directive is awaiting transposition which is due on 27 October 2013.



Directive 2010/18/EC implementing the revised Framework
Agreement on parental leave concluded by BUSINESSEUROPE, UEAPME, CEEP and ETUC and repealing Directive 96/34/EC
Date adopted: 8 March 2010
Transposition deadline:  8 March 2013
Current position: The Directive will be transposed as part of national proposals to consolidate all similar national legislation, including maternity, adoptive, paternal and carers leave into the one legislative act.



Directive 2011/93/EU of the European Parliament and of the Council of 13 December 2011 combating the sexual abuse and exploitation of children and child pornography, and replacing Council Framework decision 2004/68/JHA

Transposition deadline: 18 December 2013
Current position: The Directive is awaiting transposition which is due on 18 December 2013.



Directive 2012/13/EU of the European Parliament and of the Council of 22 May 2012 on the right to information in criminal proceedings
Date adopted
: 1 June 2012
Transposition deadline: 2 June 2014
Current position: The Directive is awaiting transposition which is due on 2 June 2014.
